How Do You Prove Malpractice?

In order to prove that a doctor was negligent in your healthcare or that of a loved one, there are four basic tenets that must be proven in court. These are colloquially known as the “4 D’s of Medical Malpractice.”

What Are the 4 D’s of Malpractice?

  2. Deviation – this D expresses that the healthcare professional must have gone outside, or deviated, from what is widely considered as standard procedure of care given the patient’s health and circumstances. If the doctor does not deviate from normal procedure, but the patient is injured nonetheless, it is unlikely that the claim will be successful.
  3. Direct – the doctor’s Deviation from established guidelines of care must be proven to have directly caused the injuries or damages. If a direct relationship cannot be established, then the compensation awarded is likely to be substantially diminished if not completely denied.
  4. Damages – if no damages occurred, then the patient has no legal foundation upon which to base their claim. Simply put, No damages = No case.
